About the Secretariat:




Ensuring neutrality and integrity in project awarding procedures to deliver swift justice to enhance investor confidence.

The General Secretariat of the Committee for Appeals Against PSP Project Tendering and Awarding Procedures is responsible for providing legal and administrative support to the Committee, as well as overseeing all procedures and managing the preparation and exchange of memoranda. The Secretariat reviews and analyzes appeals, prepares reports for the Committee’s consideration, and conducts legal, financial, and technical research and consultations as needed. In addition, it supervises all aspects of the Committee’s operations.

Processing appeals with precision, excellence, and efficiency—without disrupting the tendering and awarding process.

Objectives:

  • Supporting the Committee in achieving fairness and prompt decision-making.
  • Ensuring the delivery of high-quality analysis of appeals related to the tendering and awarding of PSP projects, through the preparation of well-developed legal and financial studies.

The documents required for registering appeals, as well as the procedures set out in Article (14) of the Rules Governing the PSP Projects’ Appeals Committee, include the following:
  • Submission of the appeal using the official form approved by the General Secretariat of the Committee for Appeals Against PSP Project Tendering and Awarding Procedures (Appeal Submission Form). The form must be completed electronically using electronic means and not handwritten. The complainant must submit the form via the official email of the General Secretariat GS@ncp.gov.sa within the legally specified timeframe.
  • The complainant must attach all supporting documents and evidence related to the appeal, including all necessary legal documents and a copy of the proof of legal capacity.
  • Submission of an unconditional and irrevocable bank guarantee in favor of the National Center for Privatization & PPP (NCP), issued by a bank licensed to operate in the Kingdom. The value of the guarantee shall be determined based on the value of the project.
  • Submission of the appeal request to the General Secretariat of the Committee for Appeals Against PSP Project Tendering and Awarding Procedures within ten (10) days from the date of the contested procedure.

The Committee for Appeals Against PSP Project Tendering and Awarding Procedures



About the Committee:
As stipulated in Article (39) of the PSP Law, this committee was established to review appeals submitted in relation to the tendering and awarding procedures of PSP projects. The committee has the authority to accept an appeal, confirm its validity, determine any compensation due, or reject it and confirm its invalidity.


Scope of Work:
The committee reviews grievances related to the procedures of tendering and awarding PSP projects, including:

  • Appeals concerning the terms and requirements stated in the Request for Qualifications (RFQ) or Request for Proposals (RFP).
  • Appeals related to the evaluation results of qualification submissions and the list of prequalified bidders.
  • Appeals concerning the evaluation of proposals and the selection of the preferred bidder.
  • Appeals related to the final award decision.



Structure:
The committee is formed by a resolution of the Board of Directors and may include one or more committee, consisting of at least five members, including the Chairperson and Vice Chairperson. At least two members must have legal qualifications, and all members must possess the necessary expertise, professionalism, and independence to perform their duties effectively..
